Return and refund policy

This policy sets out the terms on which Tranquil Lighting accepts returns, exchanges, and refunds. It is drafted in line with South Africa's Electronic Communications and Transactions Act (ECT Act) and Consumer Protection Act (CPA), and reflects the minimum protections required by law. All returns are subject to the conditions below; we reserve the right to refuse any return that does not meet them.

 

1. Your 7-Day Cooling-Off Right

South African law (ECT Act, Section 44) entitles you to cancel your order within 7 days of receiving your goods, without giving a reason. This right is subject to the following conditions, which we apply strictly:

  • The item must be returned unused, uninstalled, and in its original condition, in its original, undamaged packaging, with all accessories, manuals, mounting hardware, protective film, and labels intact.
  • You must notify us in writing within the 7-day window. The 7 days runs from the date of delivery as recorded by our courier, not the date you contact us.
  • You are responsible for the direct cost of returning the item. We do not cover or reimburse return shipping for cooling-off cancellations.
  • Every returned item is inspected on arrival. If the item is not in the condition described above, we reserve the right to refuse the return, or to deduct the cost of missing parts, repackaging, or diminished resale value from your refund.
  • Once inspection is complete, we'll process your refund within 30 days, via your original payment method.

Exclusions: Items made or customised to your specifications (e.g. bespoke fittings, custom finishes, cut-to-length track systems) are not eligible for cooling-off cancellation, as permitted under the ECT Act.

2. Faulty, Damaged, or Incorrect Items

South African law (CPA, Section 56) provides a 6-month implied warranty from delivery for goods that are genuinely defective, unsafe, or not fit for purpose. This is a statutory right and applies regardless of this policy. To bring a claim under it, the burden is on you to demonstrate the defect is a manufacturing fault and not the result of installation, misuse, normal wear, or external factors (e.g. power surges, incorrect wattage bulbs, water ingress on indoor-rated fittings).

  • Report transit damage within 48 hours of delivery, with photos of the item, packaging, and shipping label. Claims reported after this window may be treated as a general defect claim rather than a transit-damage claim, and assessed accordingly.
  • For other defects, contact us as soon as the issue is noticed, with your order number, photos/video, and a description of how the item was installed and used.
  • We reserve the right to inspect the item, request a qualified electrician's assessment, or decline a claim where the evidence does not clearly establish a manufacturing defect.
  • Where a defect is confirmed, our first offer will be repair or replacement; a refund will be considered where repair or replacement is not reasonably possible.

3. Non-Returnable Items

The following cannot be returned, except where a genuine manufacturing defect is confirmed under Section 2:

  • Custom-made, bespoke, made-to-order, or special-order fittings
  • Clearance, sale, ex-display, or "final sale" marked items
  • Light bulbs, LED drivers, remotes, or globes once removed from sealed packaging (hygiene/safety)
  • Smart/app-paired lighting products once paired, configured, or connected to a network
  • Items that have been installed, wired, or altered by an electrician or any third party
  • Items missing original packaging, manuals, mounting hardware, protective film, or labels
  • Items showing any sign of use, installation, scuffing, or damage not present at delivery
  • Items returned without a valid Return Authorisation (see Section 5)

4. Installation & Electrical Safety

  • All electrical work must be carried out by a qualified, licensed electrician in accordance with SANS standards. We strongly recommend retaining proof of installation (invoice, certificate of compliance) as this may be requested to support any future warranty claim.
  • We are not liable for damage, injury, fire, or warranty voidance resulting from incorrect installation, unqualified installation, incompatible dimmers/drivers, incorrect bulb wattage, or misuse.
  • It is your responsibility to inspect all items and confirm compatibility with your electrical setup before installation. Once an item has been wired in, we treat this as acceptance of the item's condition, and will only consider a claim where a manufacturing fault is clearly established and unrelated to installation.

5. How to Request a Return

  3. We will assess eligibility and, if approved, issue a Return Authorisation (RMA) number. Items sent back without a valid RMA will not be accepted, and will be returned to you at your cost.
  4. Pack the item securely in its original packaging. Damage occurring in return transit due to inadequate packaging is your responsibility.
  5. Once received and inspected, we'll process your refund/replacement within 30 days of confirming eligibility.

6. Refunds

  • Refunds are issued via the original payment method, in ZAR, unless we agree otherwise in writing.
  • Original delivery fees are non-refundable, except where the return is due to our error or a confirmed defect.
  • Refunds may be reduced to reflect missing accessories, damaged packaging, or diminished resale value, as assessed on inspection.
  • Please allow up to 10 business days for the refund to reflect, depending on your bank.

7. Damaged in Transit

  • You must inspect your delivery on arrival, before signing for it where possible.
  • Report transit damage within 48 hours, with photos of the item and outer packaging, and your order number. Claims made after this window will be assessed under Section 2 as a general defect claim, which carries a higher evidence burden on you.
  • Where damage is confirmed as transit-related, we'll arrange collection and issue a replacement where stock allows, or a refund.

8. Our Right to Refuse

We reserve the right to refuse any return, exchange, or refund request that does not strictly meet the conditions set out in this policy, including where an item shows signs of use or installation, packaging or accessories are missing, the request falls outside the stated timeframes, or a Return Authorisation was not obtained in advance. This policy does not limit your statutory rights under the ECT Act or CPA — where a term of this policy conflicts with a right you cannot legally waive, the statutory right prevails.

Shipping policy

This policy explains how we process, dispatch, and deliver orders placed on the Tranquil Lighting website.

1. Delivery Areas

We currently deliver to addresses within South Africa only. We do not offer international shipping at this time.

2. Processing Time

  • Orders are processed within [1–3] business days of payment confirmation, excluding weekends and public holidays.
  • During high-demand periods (sales, month-end, holidays) processing may take slightly longer — we'll notify you if this affects your order.
  • Custom, made-to-order, or backordered items may require additional processing time, which will be communicated at checkout or by email.

3. Delivery Timeframes

  • Standard delivery takes 10–14 business days from dispatch, depending on your location and courier availability.
  • This is an estimate, not a guaranteed delivery date. Remote or outlying areas may take longer.
  • We use third-party couriers, including DPD and The Courier Guy, to fulfil deliveries. Once your order is handed to the courier, delivery timing is subject to their network and service levels, which are outside our direct control.
  • In line with South African law (ECT Act, Section 46), if your order has not been delivered within 30 days of purchase, and no extended timeframe was agreed with you in writing, you're entitled to cancel your order and receive a full refund.

4. Shipping Costs

  • Standard delivery is a free, regardless of order size or delivery location within South Africa.
  •  For cooling-off cancellations or non-defective returns, the customer is responsible for the direct cost of returning the item to us . Full detail is set out in our Returns & Refund Policy.

5. Order Tracking

  • You'll receive a shipping confirmation email with tracking information once your order is dispatched.
  • Please allow up to 24 hours for tracking information to update after dispatch.
  • For tracking queries once your order is with the courier, you may also contact DPD or The Courier Guy directly using the tracking number provided.

6. Delivery Address & Failed Deliveries

  • You are responsible for providing a complete and accurate delivery address, including any access codes, building details, or special instructions.
  • We are not liable for delays or non-delivery caused by an incorrect or incomplete address supplied at checkout.
  • If a delivery attempt fails because no one was available to receive the order, the courier may leave a notice, attempt redelivery, or return the parcel to a local depot for collection, depending on their process. Redelivery fees may apply and are the customer's responsibility.
  • If a parcel is returned to us as undeliverable due to an address error or repeated failed delivery attempts, we will contact you to arrange redelivery at your cost, or a refund less the original shipping cost.

7. Risk & Title

Risk in the goods, including risk of loss or damage in transit, passes to you on delivery to the address provided at checkout. See our Terms of Service for details on when ownership transfers.

8. Split Shipments & Backorders

  • Orders containing multiple items may be shipped in separate parcels, depending on stock location and size/weight, at no extra cost to you.
  • If an item is out of stock after your order is placed, we will contact you with the option to wait for restock, substitute the item, or receive a refund for that item.

9. Damaged, Lost, or Missing Parcels

  • Please inspect your delivery on arrival where possible.
  • Report transit damage, loss, or shortages within 48 hours of the expected delivery date, per our Returns & Refund Policy.
  • Claims reported outside this window may be more difficult to verify with the courier and may affect our ability to assist.

10. Large or Fragile Items

Certain items (e.g. large chandeliers, glass fixtures) may require special courier handling and could take longer to arrive than smaller items. Any known extended timeframes for specific products will be noted on the product page.

Terms of service

These Terms of Service ("Terms") govern your access to and use of the Tranquil Lighting website (the "Site") and any purchase you make through it. By browsing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Who We Are

Tranquil Lighting is an online retailer of lighting fixtures and related products, operating in South Africa. Contact details are provided in Section 15.

2. Eligibility

You must be at least 18 years old, or have the consent of a parent or legal guardian, and have the legal capacity to enter into a binding contract to place an order on this Site. By placing an order, you confirm that you meet this requirement.

3. Product Information & Pricing

  • We make reasonable efforts to display product images, descriptions, dimensions, and specifications accurately. However, colours, finishes, and scale may vary slightly due to photography, screen settings, and manufacturing batch variation. Minor deviations from images are not considered a defect.
  • All prices are displayed in South African Rand (ZAR), inclusive of VAT where applicable, and exclusive of delivery charges unless stated otherwise.
  • We reserve the right to correct pricing or product errors at any time, including after an order has been placed. If a pricing error is discovered after you've paid, we will contact you to either confirm the order at the correct price or cancel it with a full refund — we are not obligated to honour an incorrectly displayed price.
  • Product availability is not guaranteed until your order is confirmed. Items may sell out between browsing and checkout.

4. Orders & Acceptance

  • Placing an order constitutes an offer to purchase, which we may accept or decline at our discretion (for example, in cases of suspected fraud, pricing errors, or stock unavailability).
  • A contract of sale is only formed once we send you an order confirmation email. Receipt of your payment does not, by itself, constitute acceptance of your order.
  • We reserve the right to limit order quantities, refuse service, or cancel orders at our sole discretion, including after an order has been confirmed, with a full refund issued in that event.

5. Payment

  • Payment is required in full at checkout via the payment methods offered on the Site.
  • You warrant that any payment information you provide is accurate and that you are authorised to use the payment method.
  • We are not liable for delays or failures caused by third-party payment processors.
  • We reserve the right to refuse or cancel an order where payment cannot be verified, or where we suspect fraudulent activity.

6. Delivery

  • Estimated delivery timeframes are provided in good faith and are not guaranteed. Delays caused by couriers, weather, stock availability, or circumstances beyond our control are not our responsibility, though we will assist in tracking and resolving delays where possible.
  • Risk in the goods, including risk of loss or damage, passes to you on delivery to the address provided at checkout.
  • It is your responsibility to provide an accurate delivery address and ensure someone is available to receive the goods. Redelivery fees may apply for failed delivery attempts due to incorrect address information or unavailability.

7. Risk, Title & Retention of Ownership

  • Ownership of goods passes to you only once full payment has been received by us, notwithstanding that risk passes on delivery under Section 6.
  • Until full payment is received, we retain the right to reclaim goods.

8. Installation & Product Use

  • Tranquil Lighting sells lighting fixtures and components. We are not electricians and do not provide installation services.
  • All installation must be carried out by a qualified, licensed electrician, in compliance with SANS standards and any applicable municipal by-laws.
  • We are not liable for any injury, damage, fire, or loss arising from installation, wiring, or use of our products by unqualified persons, or from installation that does not comply with applicable electrical codes.
  • It is your responsibility to confirm a product's specifications (voltage, wattage, IP rating, dimmer compatibility, etc.) are suitable for your intended use before installation.

9. Returns & Refunds

Returns, exchanges, and refunds are governed by our separate Returns & Refund Policy, which forms part of these Terms. Please review it before purchasing.

10. Intellectual Property

  • All content on this Site — including product photography, logos, descriptions, graphics, and layout — is owned by or licensed to Tranquil Lighting and is protected by copyright and trademark law.
  • You may not copy, reproduce, distribute, or use any content from this Site for commercial purposes without our prior written consent.

11. Acceptable Use

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms;
  • Attempt to gain unauthorised access to the Site, our systems, or other users' accounts;
  • Interfere with the Site's functionality, including via bots, scraping, or malicious code;
  • Submit false, misleading, or fraudulent information, including fraudulent payment details.

We reserve the right to suspend or terminate access to the Site for any user who violates these Terms.

12. Limitation of Liability

  • To the maximum extent permitted by law, Tranquil Lighting's total liability to you for any claim arising from your use of the Site or purchase of a product is limited to the purchase price of the relevant product.
  • We are not liable for any indirect, incidental, or consequential loss, including loss of profit, loss of data, or damage to property, arising from installation, use, or misuse of our products, except to the extent such liability cannot be excluded under the Consumer Protection Act.
  • Nothing in these Terms limits any right or remedy you have under the Consumer Protection Act or the Electronic Communications and Transactions Act that cannot lawfully be excluded or limited.

13. Indemnity

You agree to indemnify and hold Tranquil Lighting harmless from any claim, loss, or damage (including reasonable legal costs) arising from your breach of these Terms, misuse of our products, or installation carried out by an unqualified person.

14. Privacy & POPIA

We process personal information in accordance with South Africa's Protection of Personal Information Act (POPIA). Please refer to our separate Privacy Policy for details on what we collect, how we use it, and your rights as a data subject.

17. Governing Law & Disputes

These Terms are governed by the laws of the Republic of South Africa. Any dispute will first be referred to good-faith negotiation between the parties; unresolved consumer disputes may be referred to the Consumer Goods and Services Ombud (www.cgso.org.za) or the National Consumer Commission. Nothing in this clause prevents either party from approaching a court of competent jurisdiction.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect, and the invalid provision will be interpreted to best reflect its original intent within the bounds of the law.
